目前网络上的信息很多，移民局再次强调最终的细则仍未发布，以最终公布的政策细则为准。

1  What is the name of this new Resident Visa category?

该居民签证类别被正式命名为 2021居民签证，在移民局的操作手册中的编号为S6。

In Ops the instructions will appear as "S6 2021 Resident Visa Category" and so INZ have been calling it the S6

2  What are the conditions of the visa?

2021居民签证的签证条件仍然在确定中，将于10月末公布。获批该签证的申请人将可以在两年后申请永久居民签证。

The visa conditions for the new 2021 Resident Visa are still being worked through and will be available on INZ’s website by the end of October.

Clients may be eligible to apply for Permanent Residence after holding this visa for 2 years.

3  What is the application fee?

2021居民签证的申请费仍在确定中，将在10月末公布。费用大致会在技能移民和工作转居民签证的申请费用之间。

(双子注：目前的技能移民申请费为$2710，工作转居民签证的申请费为$1800.)

We are still working through the cost of the application and expect to have more detail on that by the end of October.

The application fee will be available on our website when it has been decided.

It is likely to fall somewhere between the current fees for an SMC visa and a RFW visa, so for people who have already paid for a residence visa application some will be eligible to a refund of the difference and others will have to pay more.

4  Can I withdraw and get a refund for my SMC EOI/other application fee?

可以撤销技术移民或技术移民EOI申请并申请退费吗？

移民局将在正式开放申请前为已提交技能移民申请或技能移民EOI的申请人提供更多信息。移民局建议在2021居民签证申请获批后在撤销相关申请。

INZ will provide more information for people in this situation when we write to them ahead of the application process opening. Information will also be available on our website.

We recommend you only seek a refund and withdrawal of your skilled residence application or SMC EOI after you have been approved a 2021 Resident Visa

5  Applicant in Australia on day before announcement

· held or had applied for an eligible visa — on 29/09/2021, and

· travelled to Australia between 06/04/2021 and 23/07/2021 (inclusive); and

· meet criteria for settled, skilled or scarce

针对目前在澳洲短暂停留的申请人,除了需要满足申请条件，还需要是在2021年4月6日和2021年7月23日之间去往澳洲的。

6  Who is not eligible?

除了已公布的合格签证类别，其他签证类别，如旅游签证，学生签证（包括就读研究型硕士或博士课程可以全职工作的研究生），特殊目的工作签证，少于六个月的关键目的访问签证，特殊工作签证，假日工作签证，季节工作签证，投资类别签证等都不符合申请要求。

People holding any of the following visa types on 29/09/21 are not eligible:

· visitors

· students

· working holiday

· RSE visas

· Specific purpose work visa

· short-term Critical Purpose visa

· Special trade-based work visas

· those with visas issued for short-term or seasonal work

· entrepreneurs and investors

7  If I applied for an eligible work visa but it has not been granted yet, can I submit my application?

在2021年9月29日及以前提交了符合要求的签证申请并且顺利获批的申请人，将符合2021居民签证的申请要求，但这类申请人的签证必须是在2022年7月31日前获批。因为申请2021居民签证的截止日为2022年7月31日。

Once the work visa is granted, yes. People who had an application lodged for an eligible visa on or before 29/09/2021 may be able to apply for the one-off resident visa if the work visa is granted. This means it will need to be approved before 31/07/2022 to have time to submit the residence application.

8  What if my pay rate was temporarily less than the median wage due to the level 4 lockdown? Will I still be eligible?

如果申请人的工资因4级封锁期间受到影响而暂时低于工资中位数，是否还符合申请要求。

移民局知晓疫情封锁可能会对申请人的收入产生影响。移民局会采取系统方法来审核和评估申请人的工资变化。（注：双子移民顾问预测短时间内低于工资中位数的收入是可以被接受的，具体评估方式以移民局公布的政策细则为准。）

INZ recognises that the COVID-19 pandemic and current Alert Level changes may have impacted some applicants’ earnings and will take a pragmatic approach to any short-term fluctuations in pay as a result.

9  Do I need to have held an eligible WV for the full 3 years?

申请人是否需要持续3年都持有工作签证？

没有相关规定。只要申请人在2021年9月29日持有合格的签证（或已申请）并满足其他相关要求就具备资格。

No. There is no specification for any type of visa being held during this time. Provided the client has been in NZ long enough and holds or has applied for an eligible visa (as at 29/09/2021), they may be eligible.

10  What if I was unlawful at some point during the 3 years?

申请人在之前有逾期停留的历史会影响签证吗？

不会。只要申请人在2021年9月29日持有合格的签证（或已申请）并满足其他相关要求就具备资格。

This is okay. Again, provided the client has been in NZ long enough and holds or has applied for an eligible visa (as at 29/09/2021), they may be eligible.

11 When the median wage increases in Feb 2022, will the new or old median wage apply?

如果2022年2月公布新的工资中位数，申请2021居民签证时以哪个工资中位数为准。

以政策公布时候的工资中位数为准，即$27。

Eligibility is calculated at the date before announcement, when the median wage was $27 per hour. Even if the median wage increases afterwards, this will not affect the client's eligibility.

12  What will happen with nurses who still need to complete their CAP?

针对新西兰进行Competence Assessment Programme(CAP)学习的海外护士有什么政策？

持有关键目的访问签证 Critical Purpose Visitor Visa 在新西兰完成 CAP 学习并获得新西兰护士注册资格的申请人可以在2022年7月31日提交2021居民签证申请。但他们的申请在完成CAP学习和获得护士注册资格前不会被批准。

Clients who were granted a CPVV on the basis of completing their CAP and gaining occupational registration can submit an application for the one off residence pathway in order to meet the 31/07/2022 cut off date. They may not be approved until they have completed their CAP and gained occupational registration.

13  What if I have not lived with my partner for 12 months yet?

同居未满12个月的配偶也可以被包含在申请中。但是该配偶的移民申请将被推迟，直到居住满12个月后再做决定。

You can include them in your application, however we may not grant them the visa until you have lived together for 12 months. Their half of the application can be deferred in line with immigration instructions R2.1.15.5

14  Dependent children aged 25 and over

针对已经提交了技能移民，技能移民EOI，或工作转居民的申请人，他们的受抚养子女如果年龄已经超过25岁，但仍然满足受抚养子女的其他相关要求，仍然可以提交2021居民签证申请，但需要作为主申请人自己单独提交申请，不可以再被包含在父母的申请中。

Dependent children aged 25 may also be eligible for a resident visa if they were included in a Residence From Work or SMC application, or an SMC EOI.

They need to have met the criteria for dependent child when the EOI/application was submitted, and they need to continue meeting the criteria except for the age requirement.

15  Will INZ be able to process these visas? Will it be like the SMC queue?

移民局将如何处理大量的2021居民签证申请，会像技能移民一样排很久的队吗？

2021居民签证的申请标准更直观和精简，移民局有信心能够高效的处理大量的申请。而且该类申请将会被移民局优先处理。

The criteria for the 2021 Resident Visa are clear and easy to assess to ensure we can manage the expected large volume of applications in a timely way.

Processing these residence applications will be a priority for INZ.

16  What if there is another lockdown?

如果再因为疫情需要封锁，移民局将如何应对。

所有的申请都需要从网上递交，即使需要封锁移民局也可以远程办公。移民局在新西兰所有的办公室都将处理2021居民签证申请。

As the applications will be submitted online, they will still be able to be processed should New Zealand find ourselves in Alert Level 3 or 4 again.

The applications will be processed in various INZ sites across New Zealand, not just in Auckland.

17  What if my dependent child turns 17 after the announcement is made?

如果受抚养子女在2021年9月29日之后满17岁，是否可以在第一批提交申请。

不可以，需要第二批提交申请。

Then you are phase 2. Dependent children must be 17 or older on the day before the announcement is made in order to meet that criteria to apply in phase 1.

18  If I apply for this visa instead of RFW, can I apply for a further WTR visa to stay working in NZ?

申请人持有WTR工作签证，并决定申请2021居民签证，是否可以延长WTR工作签证以在新西兰继续工作？

2021年10月31日后不可以再申请WTR工作签证。可以考虑申请技能工作签证。

Not after 31 October 2021! But consider ESWV instead.

19  Will my application go to the back of the queue if I withdraw it from the SMC residence queue and apply under this new pathway?

如果我撤销技能移民申请并提交2021居民签证申请，是否需要重新排队？

2021居民签证申请将按照申请提交时间进行审理。因为该类别签证的审理标准更加精简，审理速度会比技能移民申请快很多。

Applications for the one-off residence visa will be processed in date order, but because the process is more streamlined than under the SMC applications will be decided more quickly.
